Who you are agreeing with

underway is operated by Personal Works Ltd (PERSONAL WORKS LTD), company number 14013912, registered in England and Wales. These terms are governed by the law of England and Wales. Contact: hello@underway.life.

Your work stays yours

You own everything you record and everything underway assembles from it. We claim no ownership of your footage, your transcripts or your episodes, and we will not publish, license or reuse them.

You grant us only the permission needed to run the service: storing your recordings where you have asked us to, and passing audio and text to the processors named in our privacy policy so the app can transcribe and assemble them.

If you use underway for a business, including under Company Record, we process the recordings and transcripts the business owns on its behalf. Our data processing agreement forms part of these terms for that processing, so every business customer has it without asking.

Your account

You need an account to use underway, you must be 18 or over, and you are responsible for what happens under it. One account is for one person, not a team sharing a login.

What you record

You are responsible for the content of your episodes. Do not record people who have not agreed to be filmed, do not capture screens showing other people’s private information, and do not use underway for anything unlawful. We may suspend an account being used to harm others.

YouTube

underway uses YouTube API Services to post to your YouTube channel, to read the numbers on what you posted, and to read YouTube’s public search results for what your audience looks for. By connecting YouTube you agree to be bound by the YouTube Terms of Service, and Google’s Privacy Policy applies to what Google does with it. How underway handles it is in our privacy policy.

Featured in our ads

Once your series has five or more episodes public on your underway page, we may feature your build in the advertising we run for underway, including on Facebook and Instagram, to send people to the builders directory. That can include your name, your series name, your page and clips from your public episodes. We only use what you have already made public, we never edit what you said to change its meaning, and we do not pay for it or charge for it.

It is on unless you switch it off: Settings, Publishing, Feature my build in underway’s ads. Switch it off and we stop using your build in new ads, and take it out of ads that are running as soon as we reasonably can. Everything you made stays yours.

Paying, and stopping

Paid plans are billed in advance for the period you choose. You can cancel any time, self-serve, without emailing anyone; you keep access until the end of the period you have paid for, and we do not refund part-periods unless the law requires it.

Payments are taken by Whop, which acts as the merchant of record: your card details go to Whop, Whop’s terms govern the payment itself, and your receipt comes from Whop. We see your membership status and nothing about your card.

If you are a consumer in the UK or EU, you also have 14 days from the day you first subscribe to cancel a new paid plan. underway is digital content supplied online. By starting to use the paid service during those 14 days you ask us to begin supplying it immediately, and you acknowledge that you lose that cooling-off right once we have started supplying it. Cancelling for the future still works as above — it stops the next renewal; it is not the same as the 14-day right.

If your subscription lapses, your recordings remain on your device and stay downloadable. Paying is for the processing, never for access to your own material.

What the AI does and does not do

underway edits, it cuts what you said, in the order you said it. It does not write words for you to speak, invent events, or reorder your answers to change their meaning. Automated transcription and assembly are imperfect, so review an episode before you post it. What you publish is your decision and your responsibility.

No guarantees, and limits

The service is provided as is. We aim to keep it running and your data safe, but we cannot guarantee uninterrupted availability, and you should keep your own copies of footage that matters to you.

To the extent the law allows, our total liability to you is limited to what you paid us in the twelve months before the claim. Nothing here limits liability for death, personal injury, or fraud, and if you are a consumer your statutory rights are unaffected.

Changes and ending

We may update these terms; if a change matters, we will tell you in the app before it takes effect. You can stop using underway at any time. We may close an account that breaks these terms, and will give you a chance to export your work first unless the law prevents it.
